Which controls on entrepreneurial activity will be carried out even during the state of emergency?
The Commission for Exceptional Situations has decided to introduce a moratorium, by 30 May 2021, on planned State controls carried out on the spot by bodies entrusted with control functions, pursuant to the Law on State control over entrepreneurial activity. The decision was taken at the meeting on 1 April.
However, the moratorium shall not apply to checks carried out by:
✔ National Food Safety Agency;
✔ National Agency for Public Health;
✔ The National Energy Regulatory Agency, in the field of state energy supervision;
✔ Environmental Protection Inspectorate – as regards forests, green areas, natural areas protected by the State, geological and aquatic areas.
The Commission also decided that if an economic unit, regardless of its ownership and legal form, violates health regulations, public health measures put in place by decisions of the Commission on Exceptional Situations and/or decisions of the Extraordinary National Public Health Commission, and the continuation of its activity endangers public health, the head of the territorial subdivision of the National Public Health Agency shall suspend its activity or, as the case may be, that of one of its subdivisions, for the period of the state of emergency.
We would point out that a 60-day state of emergency has been established throughout the territory of the Republic of Moldova, with effect from 1 April.
