What is the new Regulation for the export and import of dangerous chemicals?
Exporters who are to export a chemical from the Republic of Moldova for the first time will be required to notify the National Regulatory Agency for Nuclear and Radiological Activities. at least 35 days in advance the date on which the export of the chemical is scheduled to take place. Thereafter, the exporter shall notify the Authority of the first export of such chemical each calendar year at least 35 days before the date of export.
Decision No 505 of 15.7.2020 was published in the Official Gazette of 31 July for the approval of Regulation on the export and import of dangerous chemicals.
The provisions of the Regulation will apply to hazardous chemicals that are banned or severely restricted and to exported and imported hazardous chemicals, as regards their classification, packaging and labelling;
At the same time, the Regulation does not apply to narcotic drugs and psychotropic substances, radioactive materials and substances, waste regulated by the Waste Act, chemical weapons, food and food additives, genetically modified organisms.
According to the Regulation, the list of exported chemicals, as well as their parts and importing countries, will be updated every calendar year and made available through SIA “REPC” (Automated Information System Registry of Chemicals Placed on the Market of the Republic of Moldova).
The Agency and exporters will also make available additional information on exported chemicals.
Exporters will use the SIA “REPC” to submit the information necessary to fulfil their obligations under the Regulation.
The document also states that exporters/importers will provide Customs Service permissive Act issued by the designated national authority for chemicals in circulation upon their introduction into or departure from the territory of the Republic of Moldova.
Where the export of a chemical takes place in the context of an emergency situation as defined in the Emergency Inspectorate General Act, a full or partial derogation from the provisions of the Regulation may be granted by the designated national authority, in consultation with the Secretariat of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, upon reasoned request of the exporter or the importing Party or other country. A decision on that request shall be deemed to have been taken in consultation with the Secretariat, unless there is a different response within 10 days of its submission of the details of the request by the designated national authority.
The Regulation will enter into force six months after its publication, i.e. on 31 January 2021.
