What are the new provisions on temporary incapacity allowance?
Basis of calculation the temporary incapacity allowance paid from the state social security budget will be adjusted to the provisions of Law on benefits for temporary incapacity for work and other social security benefits.
Law no 149 of 16 July 2020 amending Article 14 of the current Official Gazette of 7 August was published in the Official Gazette of 7 August 2020. Law on occupational accident insurance and occupational diseases.
According to the document, the amount of the temporary incapacity allowance paid from the employer’s means will be 100 % of the employee’s average wagedetermined in the manner established by the Government. Compensation for temporary incapacity for work caused by accidents at work or occupational diseases shall be granted to insured persons irrespective of the duration of the contribution traineeship.
Previously, the amount of the allowance for temporary incapacity for work constituted 100 % of the insured average monthly salary of the insured person for the 6 months preceding the month in which the occupational accident occurred or the occupational disease was observed.
The allowance for temporary incapacity for work shall be paid for 20 calendar days, calculated from the date of temporary loss of work capacity, by the employer in which the work accident occurred or the occupational disease was found, by his own means, and from the 21st calendar day – by the National Social Insurance Agency, from the means of the State social security budget.
