According to the Official Gazette of 24 August 2021, Decision No 136 of 19.8.2021 on the amendment and repeal of certain Government Decisions was published.

According to the judgment, the secondary legislative framework providing for State control over entrepreneurial activity in the field of work, safety and health at work and the exclusion of the provisions relating to control powers in the field of safety and health at work from the Methodologies for State control over entrepreneurial activity on the basis of the risk analysis relating to the areas of competence of the sectoral control bodies has been adjusted and updated. Thus, Decision No 136/2021 amended the following legislative acts:

1) Methodology for state control of entrepreneurial activity based on risk analysis related to the areas of competence of the National Food Safety Agency, approved by Government Decision No nr.1280/2018;

2) The methodology for state control of entrepreneurial activity based on risk analysis, relating to the areas of competence of the Technical Surveillance Agency, approved by Government Decision No nr.781/2018;

3) The methodology for state control over entrepreneurial activity based on the risk analysis carried out by the Agency for Consumer Protection and Market Surveillance, approved by Government Decision No nr.782/2018;

4) Methodology for state control of entrepreneurial activity based on risk analysis carried out by the National Agency for Public Health, approved by Government Decision No nr.1014/2018;

5) Methodology for state control of entrepreneurial activity based on risk analysis in the control areas of the National Auto Transport Agency, approved by Government Decision No nr.836/2018;

6) Methodology for state control of entrepreneurial activity based on risk analysis in the areas of competence of the Civil Aviation Authority, approved by Government Decision No nr.838/2018;

7) Methodology for the State control of entrepreneurial activity based on risk analysis in the control areas of the Naval Agency, approved by Government Decision No nr.837/2018;

8) The methodology for state control over entrepreneurial activity based on the risk analysis relating to the areas of competence of the Environmental Protection Inspectorate, approved by Government Decision No nr.963/2018;

9) Methodology for state control of entrepreneurial activity based on risk analysis in the control areas of the State Labour Inspectorate, approved by Government Decision No nr.894/2018.

The principles underlying the amendment of the Methodology for State control over entrepreneurial activity on the basis of risk analysis in the control areas of the State Labour Inspectorate are:

• the identification of a single methodology for application in the field of employment relationships, health and safety at work;

• establishing risk criteria and assessing them for the areas of activity;

• creating rules for the analysis of risk criteria.

This Decision entered into force on 24 August 2021. It was also repealed on that date. Government Decision No 943/2018 approving the Methodology for State control based on risk analysis in the field of safety and health at workbecause the provisions relating to the analysis of risks to safety and health at work will be found in Government Decision No 894/2018.
