How will the procurement needed to prevent COVID – 19 be carried out?
The authorities propose flexible mechanisms and options to procure public goods, services and works to ensure continued assistance in the public health emergency.
To this end, the Government approved yesterday’s meeting on 8 July. project the decision for the approval of the Regulation on public procurement necessary for the prevention and control of COVID-19 infection. Its provisions apply to public procurement procedures initiated during the state of public health emergency, declared by Decision No 10 of the Extraordinary National Public Health Commission of 15 May 2020 necessary for the prevention and control of COVID-19 infection where the emergency situation does not allow compliance with the general time limits laid down in the Law on public procurement.
The Regulation applies to contracts the estimated value of which, net of VAT, is equal to or greater than RON 800 for goods and services and RON 2 million for works.
At the same time, for public contracts necessary for the prevention and control of infection, the estimated value of which is below the established threshold, the provisions of Regulation on low-value public procurement.
Thus, for these procurement procedures, the contracting authority has the right to organise and carry out the communication process with economic operators on paper (in case of lack of functionalities in the e-procurement system).
For the above-mentioned procurement procedures, the period between the date of publication of the contract notice in the Public Procurement Bulletin and the closing date for submission of tenders is at least 10 days for the open procedure or the restricted procedure.
In cases of extreme urgency, the contracting authority may award public supply, works and service contracts by use of the negotiated procedurewithout prior publication of a contract notice.
The contracting authority shall, no later than one working day after the establishment of the successful tender, inform all participants in writing of the results of the procurement procedure as well as the reasons for rejection, in the case of rejected tenders, and the reasons for disqualification, in the case of disqualified tenderers.
Public contracts are concluded after the 4-day standstill period has expired from the date of transmission of the communication on the outcome of the application of the award procedure.
